<p>I am starting a web business, which is still in the planning stage. We are about a week into development, and we have a skeletal web site up on a test server. We have our business plans pretty well drawn out at our project management site which uses Redmine, so all our ideas are contained in our database. All our ideas are either in our wiki or work tickets.</p>
<p>Our web site will probably not be up for the public to see for roughly a year from now. Do we need to wait until we've gone live or are really close to doing so in order to copyright?</p>

<p>We built our website upon Affero-GPL ver3 licensed LACONICA (www.laconi.ca) framework. We have built some key components, which are NOT part of original laconica distribution and have been developed by us and is NOT open source. These components are integrated with laconica through properly defined interfaces and do not use any modified laconica code for its operation.
However there are A FEW LACONICA CLASSES MODIFIED to inject the proper references into the web page for these components to be displayed.</p>
<p>These components are our Unique Selling Points and considerable amount of effort and resources have been put for developing these components and we do not plan to release the source code for these components.</p>

<p>I have the opportunity to develop a niche solution with the prospect of making some recurring subscription revenue.</p>
<p>The prospect sent me an RFP which states that one of my provisions is the solution's source code and a non-compete agreement within 100 miles of his base city.</p>
<p>While I will be using a hardware key (dongle) to copy and usage protect the application making it unusable without the hardware key, I wonder what can I do to protect/enforce/prevent/maintain source code copy rights? Having the source code they can redesign the solution and reproduce it without my consent.</p>
<p>Should I charge a substantial amount for the source code while discounting the monthly subscription fee in hopes to get the proposal approved?</p>
<p>Are there any other creative ways to close this sale with a win/win proposal?</p>

Can we just dump the database, burn that along with the web site code, content, and screenshots to a CD, and mail that in? Or does it need to be nice, neat and clearly laid out on paper / electronic document as to the specific things we are copyrighting?</p>

I want to publish it and use Google Adsense to make enough revenue to cover hosting costs (if there is a little extra, I'd like it to go into my wallet). However, the main content of the website is copyrighted material (video games, mostly).</p>
<p>If I am only reporting things like news, tips, and information about/in the games, am I covered under fair use? I would not be 'detracting from the value of the original material' in any way.</p>
<p>How would I give credit in the website itself? Is it necessary to contact the company and ask their permission? (I've read this elsewhere.) I don't want to get sued.</p>
